What is a trademark and what does it protect?
A trademark is a word, name, logo, slogan, or other identifier that distinguishes your goods or services from those of others. Do I need a trademark if I already have an LLC or business name?
Yes. Forming an LLC or registering a business name with the state does not give you trademark rights. Those filings only allow you to operate under that name locally. A federal trademark registration is what protects your brand name, logo, and identity at the national level and gives you the ability to enforce your rights against infringers anywhere in the country.
How long does the trademark registration process take?
The USPTO process typically takes 8 to 12 months from the date of filing to registration, assuming no significant issues arise.
