CARMEN ROSAS, ESQ.

Founder + Managing Attorney

Carmen is the Founder and Managing Attorney of Legacy Protection Firm, PC. With over 13 years of legal experience, Carmen is dedicated to helping families protect their loved ones and hard-earned assets. While studying for the California bar exam, Carmen’s grandmother passed away. This was Carmen’s first time having to face death and the legal formalities that unfortunately came along with it. Not only was she having to grieve for her grandmother, but at the same time, she was also having to handle the probate court, which proved to be exhausting, stressful, and expensive. Though this time was a difficult one in her life, it inspired Carmen to help others who were struggling with similar situations, and Legacy Protection Firm (formerly Carmen Rosas Law) came about.

Aki Saito, ESQ. Associate Attorney

Aki grew up going to school in the US and Japan. She received her law degree from the University of Tokyo, her J.D. from George Washington Law School, and her LL.M. in Intellectual Property from George Washington Law School. She enjoys working with families getting their estate plan in place, helping them protect the legacy that they’ve built and making them feel at ease that their loved ones will be taken care of. Prior to joining Carmen Rosas Law, Aki worked as an antitrust and intellectual property litigator at Morrison & Foerster’s San Francisco and Tokyo offices, where she represented tech companies in complex multi-district litigations. She is a Japanese and English native speaker. She spends her free time with her husband and two very active children. She loves zumba dancing and weaving Nantucket baskets.

What is Estate Planning?

What’s the difference between a Will and an Estate Plan?

A will is a part of your estate plan. It is a document that gives instructions to a judge on how you want your assets distributed. It’s also where Guardians for minor children are named.

Who needs an Estate Plan?

An Estate Plan can be beneficial to those that are married or had multiple marriages, have children, own a business, or would like to pass their assets on to someone else. It can also be helpful to those that want to make sure that their requests are being followed through.

What happens if I do not have an Estate Plan upon death?

In California, if you do not have an Estate Plan before your death then your family will have to go through probate court in order to have access to your property. The court will have to verify all of your estate and check if there is any debt that must be paid. They will specify the worth and credit of all of your assets and properly transfer them to your family or beneficiaries.

What is a probate and how does this relate to Estate Planning?

Probate is a lengthy court process brought before a judge. It takes about 18 months for completion and is very expensive. Creating a Living Trust avoids probate and makes it easier on your loved ones.

What documents do I need for an estate plan in California?

A complete estate plan in California typically includes:

▪️Revocable Living Trust – Helps avoid probate and ensures a smooth transfer of your assets.

▪️Last Will and Testament – Covers any assets outside the trust and names guardians for your children.
